Las presentes condiciones (en adelante denominadas .Aviso legal.) tienen por objeto regular el uso de esta Web que Taunology S.L. (en adelante .La Empresa.) pone a disposición del público en la presente URL. La utilización del sitio Web por un tercero le atribuye la condición de Usuario y supone la aceptación plena por dicho Usuario de todas y cada una de las condiciones que se incorporan al presente Aviso legal.

La empresa se reserva el derecho de modificar o remplazar en cualquier momento cualquiera de los Términos de Uso, o cambiar, suspender o desconectar el Servicio en cualquier momento mandando una notificación a los usuarios por correo electrónico. La empresa también puede limitar el acceso a ciertos servicios o restringir el acceso a algunas partes o contenidos de la web. El usuario es el responsable de cualquier actividad que ocurra con su cuenta. El usuario debe notificar a la empresa cualquier comportamiento irregular o no autorizado de su cuenta.

Lanzanos permite a ciertos usuarios (.Creadores de Proyectos.) tener proyectos en la Web para buscar financiación de otros usuarios (Financiadores). Toda la financiación es pagada a los Creadores de Proyectos usando el servicio PayPal o mediante la pasarela de pago seguro de TefPay. Lanzanos no es responsable de la puesta en marcha de los proyectos. Lanzanos no es responsable de cualquier daño que se pueda sufrir durante la realización de un proyecto. Lanzanos no está obligado a mediar en disputas entre Creadores de Proyectos y Financiadores. La Empresa (Taunology S L) cobrará una comisión por gastos de gestión a los .Creadores de Proyecto. sólo si su proyecto obtiene un valor mayor o igual al 100% de la financiación. Esta comisión será:

Proyectos normales : Un 5% de los fondos conseguidos a través de donaciones.

Proyectos solidarios : Un 1% de los fondos conseguidos a través de donaciones.

Al Financiador no se le cobrará la cantidad donada hasta que el proyecto alcance el 100% de la financiación, salvo en los casos en que el proyecto ya haya llegado a dicho 100%, cuyo cobro se realizará de inmediato. Las donaciones se podrán cancelar antes de que el proyecto alcance el 100% de la financiación.

Unirse a Lanzanos es totalmente gratuito pero hay ciertos servicios que llevan incluido una pequeña comisión como por ejemplo el cobro de la cantidad recaudada. Las comisiones que son recogidas por Lanzanos se detallan en el apartado de Financiación, pero no tomamos partido en las comisiones que Paypal o TefPay/CajaRural puedan cobrar al transferirle al autor de los proyectos la cantidad recaudada. Lanzanos no garantiza que, ocasionalmente y por fallos en las tarjetas de crédito, a la hora de cobrar no se alcancen las cantidades indicadas. Cuando se utiliza un servicio que tiene una comisión, el usuario tiene la oportunidad de revisar y aceptar esa comisión que será cargada según el esquema de comisiones. Todos los pagos serán realizados en Euro.

El .Creador de Proyecto. cuyo proyecto se considere financiado en su totalidad dentro de Lanzanos, contrae con el Financiador, desde el momento del ingreso de la cantidad recaudada en la cuenta de PayPal o en su cuenta bancaria, la obligación de cumplir con las recompensas que se detallan en su proyecto. Cumpliendo con las recompensas en las mismas condiciones que se explican en el apartado .recompensas. de la página de proyectos. Ajustándose siempre a la descripción que proporcionó. El plazo de envío deberá ceñirse rigurosamente a la descripción de cada proyecto, no superando nunca el año natural, salvo especificación explícita y visible fácilmente en la descripción del proyecto.

El usuario acepta que el Servicio contiene Contenido realizado por la Empresa y esteContenido tiene derechos de propiedad.

La Empresa Taunology S.L, no tienen ningún derecho de propiedad intelectual sobre los proyectos que se vayan a financiar a través de la web. La Empresa no puede comercializar ni vender estos proyectos ni obtener parte de los beneficios económicos que pueda generar el proyecto. La empresa no obtendrá ningún tipo de beneficio del proyecto después de su periodo de financiación en Lanzanos.com El Servicio proporciona la posibilidad a los creadores de proyecto de actualizar Contenido propio en la Web. La Empresa no tiene ningún derecho de propiedad sobre ese Contenido. Se le otorga a la Empresa en todo el mundo, no en exclusiva el derecho de:

1. Usar, transmitir, reproducir, codificar, copiar, mostrar, distribuir y explotar de otra manera el Contenido, junto con todas las obras asociadas de derechos de autor o metadatos, incluyendo, sin limitación, fotografías, gráficos y texto descriptivo en relación con el Servicio.
2. Permitir que otros usuarios transmitan, reproduzcan, descarguen y visualicen las obras.
3. Permitir a otros utilizar y publicar, el nombre, marcas, imágenes, materiales personal y biográfico del creador del proyecto y los miembros de su grupo, en relación con la prestación del Servicio.

El Servicio puede proporcionar a los usuarios la capacidad de agregar, crear, cargar, enviar, distribuir o publicar Contenido. Este Contenido pueden ser vídeos, clips de audio, comentarios por escrito en el foro, datos, textos, fotografías, software, scripts, gráficos, u otra información en el Sitio. Reconociendo que:

Declara, garantiza y puede demostrar que (i) posee o controla todos los derechos de todo el contenido de sus envíos de usuario, o que el contenido de dichos envíos de usuario es de dominio público, (ii) tiene plena autoridad para actuar en nombre de los propietarios de sus envíos de usuario a utilizar dicho contenido como se contempla en estas Condiciones de Uso y la concesión de los derechos de licencia establecidos anteriormente, ( iii) tiene permiso para usar el nombre e imagen de cada persona individual identificable y el uso individual de dicha identificación o información personal como se contempla en estas Condiciones de Uso.

Que el uso o explotación de dichos Contenidos de usuarios por la Empresa y la utilización o explotación por los usuarios del Sitio y de servicio como se contempla en el presente Acuerdo no infringirá ni violará los derechos de cualquier tercero, incluyendo sin limitación, cualquier derecho a la privacidad, derechos de publicidad, derechos de autor, derechos contractuales, o cualquier otra propiedad intelectual o derechos de propiedad.

El usuario entiende que la empresa tendrá el derecho a eliminar, editar, modificar, el formato, citar o traducir cualquier material, el contenido o la información presentada , y que toda la información pública o privada de transmisión a través del Sitio es responsabilidad exclusiva de la persona que ha creado dicho contenido y que la Empresa no será responsable por cualquier error u omisión en cualquier contenido, y que la Empresa no puede garantizar la identidad de otros usuarios con los que pueden interferir en el curso de la utilización del Servicio. La empresa no respalda y no tiene control sobre ninguna de las entregas de usuario. Esta no puede garantizar la autenticidad de los datos . Or impersonates any person or entity, including any employee or representative of the Company.

You may view Content on the Site without registering, but as a condition of using certain aspects of the Service, you may be required to register with the Company and select a screen name ("User ID") and password. You shall provide accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your account. You shall not use as a User ID, domain name, or project name any name or term that (1) is the name of another person, with the intent to impersonate that person; (2) is subject to any rights of another person, without appropriate authorization; or (3) is otherwise offensive, vulgar, or obscene. The Company reserves the right in its sole discretion to refuse registration of or cancel a User ID, domain name, and project name. You are solely responsible for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your password for the Site. You shall never use another User account without the other User's express permission. You will immediately notify the Company in writing of any unauthorized use of your account, or other known account-related security breach.

Lanzanos is a platform where Project Creators run campaigns to fund creative projects by offering rewards to raise money from Backers. The payment will be sent to the Project Creators through PayPal or the secured payment service from TefPay/Ruralvia Lanzanos is not responsible for the launching of the projects. Lanzanos is not liable for any damages or loss incurred related to rewards or any other use of the Service. All dealings are solely between Users. Lanzanos is under no obligation to become involved in disputes between any Users, or between Users and Backers. The company Taunology will charge a commission of 5% to the Project Creator, but only if the amount of money pledged as of the deadline is at least equal to the fundraising goal. The payment will be charged to the Backer at or after the campaign deadline and only if the amount of money pledged as of the deadline is at least equal to the fundraising goal. In case the amount of money pledged is reached before the deadline the payment will be charged to the Backer immediately. The amount Backers pledge is the amount they will be charged. Backers can cancel their pledge at any time during the fundraising campaign except that the campaign has already reached its goal.

Joining Lanzanos is completely free. However, we do charge fees for certain services, for example a small commission of the pledged amount. Detailed information about the fees charged by Lanzanos can be found under Fundraising. We do not take part in the commissions that PayPal or TefPay/Ruralvia may charge you. Lanzanos is not responsible for any occasional failures when capturing funds. When you use a service that has a fee you have an opportunity to review and accept the fees that you will be charged. All payments are in euro.

Project Creators whose campaign is successfully financed within Lanzanos agree to fulfill each reward and to comply with the conditions and description explained in the "Rewards" column of the project. Project Creators also agree to fulfill the delivery date listed on each reward. This period cannot exceed one year unless another period is clearly specified in the campaign.

You agree that the Service contains Content provided by the Company and that the Content is protected by copyrights.

The Company Taunology S.L. will not have any ownership rights over the projects to be financed through the web. Project creators keep 100% ownership of their work. The Company can not commercialize or sell the project and will not obtain any economical benefit that the project may generate. The Service offers the project creators the possibility of updating any information related to the project. The Company will not have any ownership rights over that content. However, the Company needs the following license to perform and market the Service on your behalf and on behalf of its other Users and itself. You grant to the Company

1. the right to use, edit, modify, prepare derivative works of, reproduce, host, display, stream, transmit, playback, transcode, copy, feature, market, sell, distribute, and otherwise fully exploit your User Submissions and your trademarks, service marks, slogans, logos, and similar proprietary rights (collectively, the "Trademarks")
2. permit others to reproduce, download and view the work.
3. permit others to use and publish, the User Submissions, Trademarks, names, likenesses, and personal and biographical materials of you and the members of your group, in connection with the provision or marketing of the Service.

Some areas of the Service may allow Users to create, post, send, upload, distribute or publish Content. Such Content can be video or audio clips, comments, texts, photographs, software, scripts, graphics or other kind of information, as long as: You are the owner of all the Intellectual Property Rights in the User Content you post, the content is public, or you have explicit permission from the owner(s) of all such rights to post the User Content on Lanzanos. For the purposes of this Agreement, "Intellectual Property Rights" means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory or other jurisdiction. You are publishing your User Submission, and you may be identified publicly by your name or User ID in association with your User Submission. You grant to each User a non-exclusive license to access your User Submissions through the Service, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such User Submissions solely for personal, non-commercial use. You further agree that your User Submissions will not contain third-party copyrighted material, or material that is subject to other third-party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant Lanzanos all of the license rights granted herein. The use or other exploitation of User Submissions by the Company and Users as contemplated by this Agreement will not infringe or violate the rights of any third party, including without limitation any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights. The Company shall have the right to delete, edit, modify, reformat, excerpt, or translate any of your User Submissions. All information publicly posted or privately transmitted through the Site is the sole responsibility of the person from which that content originated. The Company will not be liable for any errors or omissions in any Content. The Company cannot guarantee the identity of any other Users with whom you may interact while using the Service. All Content you access through the Service is at your own risk and you will be solely responsible for any resulting damage or loss to any party.

The Company may terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. If you wish to terminate your account, you may do so by following the instructions on the Site. All provisions of the Terms of Use that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
